Shiny, Happy Texans

The 5th U.S. Circuit Court of Appeals struck down a Texas ban on sex toys, saying it violates the right to privacy under the 14th amendment.

How did this get this far? The ban is clearly unconstitutional. I guess I shouldn't be surprised.

Clearly unconsitutional to you and me... but not to the 11th Circuit. They upheld a similar ban in Alabama in 2002, and I believe the Supreme Court refused to hear the case.

So what you can put down your pants depends which part of the bible belt you're at.

I've always thought of these as old, grand-fathered-in, statutes. It's a little shocking to realize they're still being used for actual enforcement - and being rewritten, no less!
